(hereinafter "Buyer") the careful reading of these general conditions of sale and these terms of use 

(the “Terms”) of the Site  www.griffesboutique.com, before any use of the same. 

Acceptance and compliance with these Terms are a necessary condition for the purchase of Products sold through the Site (the "Products"). 

Through the purchase of the Products, 

the Purchaser (person who makes online purchases) agrees to be bound by these Terms.

These general conditions of sale are valid exclusively between the GRIFFES company of Capano Anna and the Buyers, 

and the Site is aimed exclusively at all Buyers who are final consumers, natural persons who purchase for purposes not related to their commercial, professional or entrepreneurial activity that may be carried out. 

By accepting these Terms, the Owner offers Buyers the opportunity to use the Site and purchase products and services. 

The Purchaser, to register on the site, must be at least 18 years old, otherwise the Purchaser who registers decides to do so under his own responsibility and at his own risk and the Owner will have no responsibility for said registration and actions or omissions consequent. 

The purchase constitutes a contract of sale of movable and material goods between the Owner and the Purchaser, sold via the Internet by accessing the Sitewww.griffesboutique.com. 

These Terms are understood to be accepted by the Purchaser at the time of purchase of any Product. 

 

AVAILABILITY AND CONDITION OF PRODUCTS 

 

The product images and descriptions  available reflect the characteristics of the Products as much as possible.

The Products offered are constantly updated. 

However, the Products on the Site may not be available e 

the GRIFFES company of Capano Anna could suffer delays in updating the Products or in updating advertising on other sites. The Company also reserves the right to modify any errors present on the Site and cannot guarantee that all the images accurately reflect the real appearance of the Products and declines all responsibility if the images and colors of the Products vary on the Buyer's device due to default settings or any malfunctions. The Owner reserves the right to change or update information and correct errors, inaccuracies or omissions at any time and without prior notice to the Buyer. 

In particular, the Purchaser is informed that the Owner periodically checks that all the prices indicated on the Site are correct, although this cannot guarantee the absence of errors. In this case, the Owner reserves the right to renounce the sale and, in any case, will give the Purchaser the possibility to reconfirm the purchase of the product at the correct price or to cancel it.

The purchase order can be canceled within 24 hours of sending the order using the appropriate email form in the Contacts, thus resolving the contract and the refund of the payment made will take place within two days from the day on which the Owner became aware of the decision of the customer to terminate the contract. 

The prices, descriptions or availability of the products displayed are subject to change without notice.

 

BUYER'S REPRESENTATIONS AND WARRANTIES 

 

Buyer represents and warrants: 

• that you have the right and ability to perform on the representations and warranties set forth in these Terms;

• that all information and data sent to the Site or provided during registration are true, complete and accurate;

• not to use the Site for illegal, obscene, inappropriate, illegitimate, defamatory purposes. 

 

BUYER REGISTRATION AND ACCOUNT 

 

If the Purchaser creates an account through the Site to make the purchase, he must register by providing all the data requested in the relevant registration form in a truthful, complete and accurate manner and fully accept the privacy policy and these general conditions._cc781905 -5cde-3194-bb3b-136bad5cf58d_

The Purchaser is responsible for safeguarding his password, which is useful for accessing the Products or for any action or activity attributable to the password, both through the Products and third-party Products.

If the Purchaser becomes aware of an unauthorized use of his account or of any breaches of security, he will be responsible for immediately notifying it via the contacts present. 

In the event of any violation, the Owner may terminate or suspend the Buyer's account, without prior notification or liability, including without limitation the violation of these Terms. If you terminate your account, your rights under these Terms will cease immediately.

If, on the other hand, it is the Purchaser who wishes to terminate the account, he will be responsible for communicating this to the email address in the Contacts section, which will proceed with the cancellation of the same. 

 

PURCHASE | WITHDRAWAL | RETURNS

The purchase order has the value of a contractual proposal and is governed by these Terms.

Orders are subject to discretionary acceptance by  

Firm GRIFFES OF CAPANO ANNA.

After having carefully checked and possibly modified the information contained in the order summary, the Purchaser must select the products and check out. 

The order is placed through the order confirmation of the same and is subject to the payment of the price, taxes and shipping and payment costs indicated in the order summary form. 

The order processing receipt does not constitute immediate acceptance of the order.

The contract will be considered concluded following the sending of the Order Confirmation by the Company GRIFFES DI CAPANO ANNA to the email address provided by the Purchaser during the purchase phase. 

The Purchaser must verify the order confirmation received and report any errors, inaccuracies and/or omissions. 

The Owner reserves the right not to confirm an order by communicating to the Purchaser via the email address associated with his purchase, the possible unavailability of one or more products purchased, within 20 days of purchase._cc781905-5cde-3194-bb3b -136bad5cf58d_

In this case the company GRIFFES DI CAPANO ANNA will reimburse the price and any shipping costs incurred by the Buyer. 

In order to make the purchase, the Buyer must:

• register by providing the requested data truthfully and accurately or, alternatively, log in if you are already registered;

• provide the data requested in order to complete the order and allow the completion of the contract.

If the proposal has not been accepted due to any unavailability of one or more items, but the payment has still been made, the amount charged will be refunded to the Purchaser.

However, if the order has been confirmed and taken over, the Purchaser may only exercise the right of withdrawal as established below. 

The Purchaser has the right to withdraw from the contracts concluded within and no later than 14 (fourteen) days from the time the Product was delivered. 

In order to exercise his right of withdrawal, the Purchaser must send notice to the email address indicated in the Contact section, within the aforementioned 14 days, providing an explicit declaration of wanting to take advantage of his right of withdrawal, copy of the purchase of the Product and receipt showing the delivery date of the Product.

To make the return, the Buyer must: 

• send an email to the addressgriffesboutique.shoponline@gmail.comrequesting to be able to return and entering the reasons; 

• store the item in the original case with its accessories, sealing the package securely; 

• send the package to be returned to Griffes di Capano Anna, Corso Margherita 64, Deliceto (FG) 71026 

• for returns and exchange of goods, the shipping costs are charged to the Buyer.

The Purchaser accepts that Products purchased on sale in the OUTLET section cannot be returned to be replaced, unless otherwise declared by the Owner, if there is no further availability of stock. 

The Owner assumes no responsibility for any Products lost during the return delivery. 

Following the return, the Owner reserves the right to verify the integrity of the Product and, if the Conditions indicated in the Return section are not complied with, in whole or in part, 

not to replace or refund the purchased Product. 

Please note that all changes will be authorized and made on the basis of stock availability.

The Owner reserves the right to report to the competent authorities any orders placed in a name other than that of the Purchaser. Furthermore, the Owner reserves the right to cancel orders and notify the competent authorities if there are suspicions of possible fraud.

 

The Purchaser who has correctly exercised the right of withdrawal will be entitled to a refund of the amount paid in favor of the Company GRIFFES DI CAPANO ANNA, with the exception of delivery costs, no later than 14 days from the day on which the Company GRIFFES DI CAPANO ANNA is informed of the Buyer's decision to withdraw from this contract. 

These refunds will be made by bank transfer, unless the Purchaser has expressly agreed otherwise. 

The refund may be suspended until receipt of the goods. 

Following the exercise of the right of withdrawal, the Purchaser must return the Product without undue delay and, in any case, no later than 14 days from the date of communication of the withdrawal.

Return risks, such as theft, loss and/or delays, and related shipping costs will be borne by the Purchaser.

The return will be considered correctly exercised if the returned goods are intact, unused, not damaged, including the original packaging, labels and protective stickers intact. 

The Purchaser is responsible for the decrease in the value of the Product resulting from an alteration of the characteristics and/or functioning of the Product itself resulting from a handling of the goods other than that necessary to establish the characteristics, nature and functioning of the goods._cc781905- 5cde-3194-bb3b-136bad5cf58d_

 

The Purchaser can also decide at the time of the return to obtain, as an alternative to a refund, a voucher equal to the amount of the returned Product, excluding the initial shipping costs, valid for 30 days from the day on which the voucher is generated, that can be used to make a change based on stock availability. 

At the time of the exchange, the Purchaser is aware of the possibility of having to pay a difference if the selected Product has a higher price than the returned Product. 

 

LIMITATIONS OF THE RIGHT OF WITHDRAWAL ON PRODUCTS

If the returned Product is: 

• even partially damaged 

(for example slipped or with signs of wear, abrasion, nicks, scratches, deformations, etc.); 

• not complete with all its accessory elements (including the labels and tags, unchanged and attached to the Product); 

• not having original packaging and certificate of guarantee, where present;  

the Products will not be replaced or refunded and the purchased Product will be returned to the Purchaser with shipping costs borne by the Purchaser. 

The Purchaser must also peremptorily insert a copy of the delivery document received inside the packing box. 

To this end, therefore, the Purchaser is invited not to alter the Product beyond what is strictly necessary to establish its nature, characteristics and functioning and to cover the original Product wrapping with other protective packaging that preserves its integrity and protect it during transport also from writing or labels. 

Furthermore, the right of withdrawal does not apply to: 

• goods made to measure or clearly personalized or which by their nature are liable to deteriorate rapidly, are sealed and are not suitable for being returned for hygienic or health protection reasons and have been opened after delivery.

 

The Purchaser accepts that Products purchased on sale, belonging to the OUTLET category, cannot be returned to be replaced, unless otherwise declared by the Owner, if there is no further availability of stock. 

 

SHIPPING

Orders will be shipped and delivered to the address expressly indicated by the Purchaser at the time of the order no later than 15 days from the date of receipt by the Purchaser of the order confirmation email sent by the GRIFFES DI CAPANO ANNA COMPANY.

Usually delivery takes place between 2-3 working days, sometimes even less. 

Shipping is:

• equal to € 9.00 for payment by card and bank transfer;

• equal to € 13.00 for cash on delivery.

 

 

The Buyer is aware and undertakes to 

• not to publish content on the Site or other sites that may contain voluntarily incorrect, obsolete, modified or counterfeit information regarding the Products;

• not to store sensitive data on the Site and to bear the responsibilities deriving from the failure to protect the information entered on the Site with the exception of the personal data essential for creating an account;

• take the utmost care of the password without communicating it and making it available to others. If, in any case, the Purchaser allows third parties to use his account, he will be personally liable for any violation of these Terms and consequent damages. 

The Purchaser further agrees, once access to the Site has been obtained, to refrain from carrying out any activity that discredits the quality or compromises the functionality of the Site or the Products offered. The Purchaser may not enter personal data and/or images of third parties on the Site without having first acquired the express consent of the interested party to the processing of personal data and their communication to third parties.

 

Deliveries are made during normal working hours to the address indicated by the Purchaser and in the manner specified in the order summary. Upon delivery, the Purchaser must check the contents immediately specifying any anomalies in the delivery form.  The Company GRIFFES DI CAPANO ANNA cannot be held responsible for delivery errors due to inaccuracies or incompleteness in completing the purchase order by the Purchaser, for damage that may have occurred to the Products after delivery to the carrier or for delays in delivery attributable to it.

 

INTELLECTUAL PROPERTY

The Purchaser also declares:

• not to change, through the use of any electronic or conventional means, reproduce, copy, imitate, use for any purpose without the prior express authorization of the company griffes di capano Anna, in whole or in part the material contained in this Site;_cc781905-5cde -3194-bb3b-136bad5cf58d_

• not to harass, defame, offend, harass, threaten or otherwise violate the rights (such as the right to privacy and publicity) of others;

• not to use the Site in any other inappropriate manner prohibited by these Terms;

• to undertake to respect these rights and not to compromise in any way the exercise by the legitimate owners; 

• to be informed that every single distinctive sign such as name, image, photograph, written text or graphic contained and used on the Site or relating to the Products are and remain the exclusive property of the Company  GRIFFES DI CAPANO ANNA or of the his assignees (the one  who acquires a derivative right), without the purchaser deriving any right over the same from accessing the Site and/or from the purchase of the Products._cc781905-5cde -3194-bb3b-136bad5cf58d_

The Owner reserves the right to terminate the accounts of Buyers who violate the property rights of the company itself. 

The Owner guarantees the authenticity of all the Products present and purchased on the Site.

Pursuant to article 1341 of the civil code and 1342 of the civil code, all the clauses of the contract have been specifically accepted by the customer/consumer.
